Very Poor Investigation by Police Officer Mr. William Ng #9683 and he lies to the court.

 

Synopsis:

Cyclist came into the driving lane, kicked my car, got hit, fell down, but lied to police that I had gone into the bicycle lane and hit the cyclist.  Mr. William Ng #9683 by his investigations charged me with assault with weapon and dangerous driving. The video I got much later from a nearby building.

 

1.      The first person to give evidence in the case was police officer Mr. William Ng #9683 who investigated the case. I asked him whether he asked the cyclist as well as the witness where the collision had occurred. He said, no, as the evidence at the scene was very clear, the collision had occurred in the bicycle lane. I asked him since this was a basic question why he did not ask them? He said that there was no need to.

2.      At that point Mr. William Ng #9683 was not aware that I had a video from a nearby building, which I had got several months after they had charged me which showed the cyclist leaving the bicycle lane, coming into the driving lane and kicking my car. Moreover, Police officer Mr. William Ng deliberately misled the court that he had not asked the cyclist, where the collision had occurred because, they do not give the victim's statement to defendants who are self-represented. In my case the victim’s statement was not given to me.

3.      Later it was found that the constable had taken a statement from the cyclist in which he had asked the cyclist where the impact had happened and the cyclist had told him that he was riding his bicycle in the bicycle lane when the car came into the bicycle lane and ran over him. Even after he was given time to check his notes Constable William Ng #9683 had lied to the court that he had not asked the cyclist, where the accident had occurred?

4.      I asked him whether the accident could have taken place in the driving lane? He said not possible, not with all the evidence that was there. He said that there was a gash on the road. The road was porus, hence the glass pieces could not have moved. I asked him whether he had any training in investigation. He said that he had an impressive list of trainings based on which he had decided that the collision had occurred in the bicycle lane. I asked him whether he would have charged me had the accident taken place in the driving lane, he said no.

5.      When asked what one should do, if someone keeps repeatedly kicking his car, Constable William Ng said that we cannot do anything, we have to call the police.  When asked whether the public will consider this as a sensible reply, he said yes.  Immediately the Judge intervened and started answering.  When asked whether if someone kept breaking the window glass of his home, what he should do, the constable said, that it was different as people were inside the house.  He does not feel that the driver or passengers inside the car are human beings. 

6.      I also asked him whether he was aware of Bill C26 for the protection of property, Mr. William Ng said that he was not aware.  The Judge Hon. Justice Mr. McLeod intervened and said that he will answer the question.  Any question, the witness or the police officer is unable to answer, immediately, the Judge will start answering or give a break.

7.      Even prior to the accident, the cyclist, kicked my car as I was driving in the driving lane anticipating that I might go into the bicycle lane.  Watch the video here.

8.      Based on the statement given by the witness and the cyclist, the police arrested me and charged me with dangerous driving and assault with a weapon. This video, I got much later from the nearby building.

9.      Every case investigated by Constable William Ng #9683 should be reopened. He must have got several people convicted without properly investigating the case. The next person to give evidence was the cyclist. He knew that I had a dashcam in my car, hence he told the court that he had come into the driving lane to hear what I was saying when the car hit him.

10.  Police also agreed that there were several cameras in nearby buildings, but they did not bother to collect evidence from them as based on their own investigation, they were confident that the accident had occurred in the bicycle lane, which means they have not investigated the case properly.

11.  At the time of the accident, I told the police several times that it was the cyclist who had come into the driving lane and kicked my car. At least, based on my statement the police should have tried to gather evidence from the other cameras. But they did not bother to do it.

12.  This is how the Toronto Police has been investigating cases, full of blunders. Based on these investigations, Judges like Hon. Mr. Justice McLeod convict those who are innocent, then prevent them from appealing their orders.   The Judgment was issued on the 6th of Jan, 2022, the very same day, I appealed the order.  I have sent several reminders.  Till now, my notice of appeal, has not been accepted by the Superior Court. 

13.  The cyclist had lied to the police that I had gone into the bicycle lane and run over him. There was a witness two cars behind me, Ms. Adrienne Koenig Woodyard, who is a prominent lawyer in Toronto. She told the police that I had gone into the bicycle lane and run over the cyclist. Based on the statement of the cyclist and the witness, the police decided to arrest me and charge me for dangerous driving as well as assault with weapon.

14.  No action is being taken against the cyclist for lying to the police as the Judge, Hon. Mr. Justice McLeod says, that the cyclist was confused which was the driving lane and which the bicycle lane was, hence he told the police that I had gone into the bicycle lane and run over him.  However, during the trial I asked the Judge, why he thinks the cyclist came into the driving lane, the Judge told me that he had come into the driving lane to kick my car, but, later, the Judge has changed his mind.

15.  The police, is not a professional police force where promotions are based on merit. Everyone joins as a constable and promotions are based on servility and sycophancy.

16.  In India, you join police in four levels. You can either join as a constable in which case the maximum you can be promoted to is a Sub-inspector of police or you can join as a Sub-inspector of police in which case the maximum you can be promoted to is a Additional Superintendent of Police or you can join as a Deputy Superintendent of Police in which case the maximum you can be promoted to is a Deputy Inspector General of Police(Colonel rank) or you can join as an Indian Police Service(IPS) officer, which is the highest level you can join at.

17.  More than five million people write the exam every year to become an IPS officer and less than 100 get selected. Any university degree, Doctors, engineers, lawyers anyone can write that exam between the ages of 21 and 30 with a maximum of three attempts, I think so. Only those who succeed that exam can go on to become chief of police, the rank is Director General of Police(equivalent to Lt. Gen in the army). Promotions are based only on seniority.

18.  So many doctors, software engineers have become chief of police. But if murder happens, within hours they will solve the crime. You cannot join as a constable and become chief of police. If you tell that in India, people will laugh at you. Some of them who have passed the IPS exam are so honest that even after they retire they are remembered as legends.

19.  Sundar Pitchai, who heads google which is the most profitable company in the world is paid $300 million a year. Thirty years ago when did they ever appoint an Indian as CEO of a global company, that too the most profitable company in the world, he would have passed a government exam in India. Had he come to Canada, he would have driven a cab.

20.  Sathya Nadella is the CEO of Microsoft corporation receiving a pay of $110 million a year. His father had passed a government exam and worked as an Indian Administrative Service officer. So those software engineers who pass the IPS exam, instead of joining the police in India, had they joined a software company, they would have been paid millions.
